The features of Products presented on the TIRE SHOP | BESTELPIESA site may be modified from time to time at the discretion of TWW. B.4<\/p>\n The Customer is responsible for complying with requirements and recommendations for safety in use of (vehicles, tires, service tools, mounting procedures, technical data, adjustments, safety standards, cautions, warnings, etc.), in installation and in storage of the Products. TWW will not be responsible in any way for installation performed by other mechanics, or use of the Products under abnormal conditions.<\/p>\n C.1<\/p>\n Products offered and corresponding prices are valid while stocks last. TWW shall use reasonable means to promptly post any price changes for Products on sale by making regular updates to its website.<\/p>\n C.2<\/p>\n If TWW is not able to deliver any Product ordered due to stock shortage, TWW will notify the Customer by email and may at that time offer the Customer to modify or cancel its order. If modified, TWW will adjust the amount of the order accordingly and confirm the modified order to the Customer by email.<\/p>\n D.1<\/p>\n All orders and Tires Inquiries must be made online through the TIRE SHOP | BESTELPIESA site, and all questions must be submitted using the Tires inquiry<\/strong><\/a> form, the contact form<\/strong><\/a>, the email: info@bestelpiesa.com, or by phone 599-9 5154430.<\/p>\n D.2<\/p>\n An Order Confirmation will be sent within 24 hours of order registration by automatic email to the email address provided by the Customer. Orders paid by bank will be processed only after receipt of customer bank transfer or deposit of payment into our bank account, corresponding to the amount shown on the Bill. D.3<\/p>\n The Customer is solely responsible regarding the information provided while submitting the order. D.4<\/p>\n In case of error in the Order submitted by the customer, the Customer must contact TWW Customer Service immediately through the contact form<\/strong><\/a>, or by the e-mail info@bestelpiesa.com, requesting the order amendment or its cancellation. This is only allowed prior the payment of the order.<\/p>\n D.5<\/p>\n TWW reserves the right to refuse any order for any reason whatsoever.<\/p>\n E.1<\/p>\n The purchase price for each product ordered is the one shown on the Site. E.2<\/p>\n Prices displayed on the TIRE SHOP | BESTELPIESA site are expressed in US Dollars and includes all Cura\u00e7ao import duties.<\/p>\n E.3<\/p>\n All delivery and installation costs are shown on the product page.<\/p>\n The sales tax (the \u201cOB\u201d) will be shown at the Cart page after adding the products to the cart.<\/p>\n E.4<\/p>\n TWW reserves the right to change the prices of Products offered on the Site at any time and without notice.<\/p>\n F.1<\/p>\n All payments must be made by bank transfer or deposited into our bank account.<\/p>\n G.1<\/p>\n TWW will deliver the Products ordered to the address provided at the time of the Customer’s order.<\/p>\n G.2<\/p>\n Products ordered by the Customer will be delivered within approximately 21<\/strong>, 45<\/strong>, or 90<\/strong> days<\/strong>, or 4-7<\/strong> business days<\/strong> to other countries by express, as selected and provided by the customer while submitting the order. G.3<\/p>\n The Customer becomes the owner of the Products ordered upon delivery by TWW, or to other countries by express to the customer address. G.4<\/p>\n No delivery will be made to a post office box.<\/p>\n G.5<\/p>\n The Customer is responsible to ensure that the Products delivered conform to the Order before the Products are installed on a vehicle. H.1<\/p>\n The Customer may request return of the Products relating to an incomplete or inaccurate shipment at any time until the end of the 7th day following receipt of the products using the contact form<\/strong><\/a>, on condition that the Products have not been installed on a vehicle or used in any manner whatsoever. H.2<\/p>\n The Customer may not return the products to TWW himself. The return request shall be made exclusively on the contact form<\/strong><\/a>. H.3<\/p>\n Upon receipt of the returned Products, any amount paid by bank transfer or deposit in favor of TWW regarding these Products, shall be credited as soon as possible but no later than 7 days, provided however that the Products being returned are received by TWW in the same condition in which they were when they were delivered.<\/p>\n I.1<\/p>\n For the purposes hereof, force majeure includes any Act of God, war, mobilization, government regulation, customs, strike, lockout, drought, flood, total or partial fire, obstruction of navigation, loss, damage or detention in transit, defective material or delays by shippers or other contingencies beyond the control of TWW which could prevent manufacture, shipping or delivery of the Products covered hereby. Performance of TWW’s obligations may be suspended in the event of force majeure without any responsibility incurred by TWW towards the Customer for any damage or loss arising from such delay.<\/p>\n J.1<\/p>\n Subject to the following, TWW guarantees that the Products sold hereby conform to the specifications and standards applicable to the industry and that title for the goods are free of any security, guarantee or mortgage. TWW shall ensure that the Customer is the beneficiary of manufacturer’s warranties and in no case shall the TWW warranty exceed that given by the Product’s manufacturers. TWW’s sole obligation under such a warranty shall be to replace the Products as the manufacturer deems necessary and to support the Customer for any claim to the manufacturer. The warranty above is the sole exclusive guarantee, express or implied, provided by the seller and supersedes all other guarantees of any nature whatsoever, contractual, legal, statutory or otherwise, for purposes of marketability, quality, compatibility or otherwise. \u00a0Any claim to the manufacturer requested by the customer, must be reported to Tire & Wheel World NV in writing using the\u00a0contact form<\/strong><\/a>, or by the e-mail info@bestelpiesa.com<\/p>\n K.1<\/p>\n TWW’s liability shall under no circumstances exceed the purchase price of the Products supplied and in no case shall TWW be liable for any indirect, consequential, special, accessory or punitive damages or for loss of business of any nature whatsoever (including damages for loss of profits) allegedly suffered by the Customer.<\/p>\n L.1<\/p>\n Trademarks and logos used or displayed on the Site are trademarks and logos, whether registered or not, of TWW or third parties. Nothing on the Site may be construed to allow, directly or indirectly, the use of such trademarks or logos without prior written authorization from their owner. L.2<\/p>\n All elements on the Site (including, without limitation, text, articles, photographs, images, illustrations, audio and video extracts, software, etc.) are protected by copyright and belong to TWW or to third parties acting as content providers. Unless clearly stated otherwise, no part of the Site may be construed as granting the Customer any right whatsoever with regards to intellectual property of TWW or a third party acting as a content provider.<\/p>\n L.3<\/p>\n The Customer may not copy, reproduce, modify, publish, distribute, participate in transfer or sale, create derivative works from, translate, download, license or exploit in any manner, any item offered on the Site (including any software), in whole or in part.<\/p>\n L.4<\/p>\n TWW is in no case responsible for the content or Products or services offered on sites to which the Site is linked by hypertext links or any other type of link. M.1<\/p>\n The United Nations Convention on Contracts for the International Sale of Goods shall not apply to this Agreement nor to any Order.<\/p>\n M.2<\/p>\n The Parties hereby accept that this Contract shall be interpreted and governed by the applicable laws of Willemstad Curacao, without regard to the principles of conflict of laws. \nThe NAME, PICTURE, SKU, SIZE and BRAND of each product is binding.
\nThere may be products offered for sale on the TIRE SHOP | BESTELPIESA site that has no pictures yet. In this case, the customer has the right to request the product’s image, or any other information regarding the product, that may be needed to the customer before placing an order.<\/p>\nC. Product availability<\/h2>\n
D. The Order<\/h2>\n
\nPlease use your Order Number as the payment reference. Your order will not be processed until the funds have cleared in our account.
\nAny order for which payment is not made within seven (7) days after receipt of the Order Confirmation by the Customer, will be automatically cancelled.<\/p>\n
\nTWW is not liable if the customer chooses an inaccurate tire size while submitting the order.
\nTWW does not accept any change of the information provided by the customer, namely: the customer (FIRST NAME, LAST NAME, COUNTRY, STREET ADDRESS, TOWN, STATE, EMAIL ADDRESS), nor of the products (NAME, PICTURE, SKU, SIZE and BRAND) after the payment of the order.<\/p>\nE. Price<\/h2>\n
\nThe purchase price for each product inquired by the customer via the TIRE SHOP | BESTELPIESA “Tires inquiry<\/strong><\/a>” form, will be sent to the customer through the e-mail info@bestelpiesa.com.<\/p>\nF. Payment<\/h2>\n
G. Delivery<\/h2>\n
\nConsequently, non-respect of any delay provoked by the local customs and shipping forwarders shall under no circumstances give rise to damages for any reason whatsoever.<\/p>\n
\nFrom this point, the Customer is bound to assume all risks and TWW is not responsible for their loss, damage or destruction.<\/p>\n
\nAny claim relating to an incomplete or inaccurate shipment shall be made within seven (7) days following the date of receipt of the Products using the contact form<\/strong><\/a>.<\/p>\nH. Cancellation of the sale<\/h2>\n
\nProducts installed shall in no case be returned or refunded.<\/p>\n
\nThe Customer will then be contacted and given all instructions as for the return of the products.<\/p>\nI. Force majeure<\/h2>\n

\nIn addition, the parties choose to submit any dispute or any proceeding arising under this Contract to the exclusive jurisdiction of the Court of Willemstad, in the judicial district of Willemstad, without prejudice to the rights of venue to obtain any precautionary measure, such injunction to any court of competent jurisdiction.<\/p>\n
